Carmel Files Injunction against the Double Apple Lounge

The City of Carmel is seeking an injunction to stop the Double Apple Lounge from operating. This establishment was recently accused twice in less than four months by the Indiana State Excise Police of having minors on the premises and in the bar consuming alcohol and/or in possession of alcohol.  The City believes the defendants are likely to continue the practice of serving minors if the Double Apple Lounge remains open.

Today the City filed a complaint against the owners of the Double Apple Lounge, Miguel Angel Sarria, Reba Bentz and Gladys Bonita. The City is seeking an order to abate a nuisance, an injunction against the nuisance and for damages. The Double Apple Lounge has created and maintained a public nuisance by operating a bar and restaurant in ways that unreasonably interferes with the public health, welfare and safety, within the City of Carmel.

“The City of Carmel will not tolerate this type of business posing such a threat to the youth in our community. We are determined to take whatever action necessary in order to ensure that a business run in this manner does not continue,” said Mayor Jim Brainard.

The defendants have permitted minors present in the bar, allowed minors to consume alcohol on the premises and served alcohol to minors. They have also negligently, knowingly and/or recklessly hired minors in a bar and employees to work within the bar without the proper licenses or permits required for the service of alcohol.

The defendants have continuously maintained and operated in violation of numerous Indiana alcohol and employment laws, in a manner that adversely affects the community and that creates a public nuisance. This adversely affects not only the minors who are permitted to enter the bar, consume alcohol in the bar and/or work in the bar, but also the surrounding community.

Defendants have failed to abate conditions, correct violations, or demonstrate any intent to permanently correct the conditions that cause the business to be a public nuisance
