Alleged NWMS shooter plea hearing set for Nov. 5

The alleged Noblesville West Middle School shooter, David J. Moore, will appear in Hamilton County Circuit Court next week.

At 9 a.m. Nov. 5, Moore is expected to plead guilty to charges of shooting teacher Jason Seaman and student Ella Whistler May 25 after his lawyers, Ben Jaffe and Chris Eskew of Eskew Law, LLC, filed a motion Sept. 5 to continue his scheduled fact-finding hearing on Sept. 10 and 11, replacing it with an admission and uncontested fact-finding with disposition, which is the sentencing portion of a juvenile hearing.

Charges against Moore include:

  • Attempted Murder, a Level 1 felony
  • Attempted Murder, a Level 1 felony
  • Aggravated Battery, a Level 3 felony
  • Aggravated Battery, a Level 3 felony
  • Battery by Means of a Deadly Weapon, a Level 5 felony
  • Battery by Means of a Deadly Weapon, a Level 5 felony
  • Possession of a Firearm on School Property, a Level 6 felony
  • Possession of a Firearm on School Property, a Level 6 felony
  • Dangerous Possession of a Firearm, a Class A misdemeanor
  • Dangerous Possession of a Firearm, a Class A misdemeanor
  • Possession of a Knife on School Property, a Class B misdemeanor

A seventh-grader at NWMS at the time of the shooting, Moore is alleged to have opened fire in his science class after asking to be excused and returning with .22- and .45-caliber handguns. Whistler, now an eighth-grader at the school, was shot seven times. Seaman was shot three times. Only the .22-caliber was used.

Moore first appeared publicly in court on June 11 when original fact-finding hearing dates of June 25 and 26 were set. Moore’s attorneys filed a motion for a continuance June 18, which set the Sept. 10 and 11 fact-finding hearing dates. The third motion for a continuance was filed Sept. 5, setting the Nov. 5 court date.

Moore is being held in the Hamilton County Juvenile Detention Center in Noblesville, where he has been since his May 25.
